General Terms and Conditions ENTI
Article 1 – General
1.1 These general terms and conditions apply to every use of the website BYENTI.com and to all offers, quotations and agreements concluded between you and BYENTI.com.
1.2 By using the website, you agree to these terms and conditions.
Article 2 – Offers
2.1 All offers on the website are non-binding, unless expressly stated otherwise. Offers do not automatically apply to repeat orders.
2.2 BYENTI.com cannot be held to an offer if you can reasonably understand that there is an obvious mistake or clerical error.
2.3 All prices stated include VAT. Any shipping costs will be stated separately before completing the order. These costs depend on the size of the order and will not be reimbursed in case of a return.
2.4 Discount codes and free shipping cannot be combined with already discounted or sale items.
2.5 Offers in the store and online are separate, unless stated otherwise.
Article 3 – Data
3.1 You are responsible for providing correct and complete information, including e-mail address, address details, and bank account number.
3.2 BYENTI.com guarantees that personal data will be handled carefully and will not be provided or sold to third parties without your permission.
3.3 Your data will be used for the execution of the agreement and, if permitted, for commercial purposes such as newsletters.
3.4 You can always view and adjust your personal data via the website.
Article 4 – Formation of the agreement
4.1 The agreement is concluded at the moment your order is received by BYENTI.com.
4.2 Changes to the agreement are only possible after explicit approval from BYENTI.com.
Article 5 – Delivery
5.1 Orders are delivered to the address you specify, unless otherwise indicated. The standard delivery time is a maximum of 5 working days, unless stated otherwise. Shipping only takes place from Monday to Thursday. During collection launches or holidays, the delivery time may be longer.
5.2 You are obliged to accept the order at the time of delivery.
5.3 If delivery is refused or not possible due to incorrect or incomplete information, additional costs will be charged to you, and storage will be at your expense and risk.
5.4 In case of an incorrectly provided address, the extra shipping costs are at your expense.
5.5 If the maximum delivery time of 10 working days is exceeded (with the exception of pre-orders or incorrect data), you have the right to cancel the agreement free of charge. To do this, you must inform BYENTI.com in writing (by e-mail, letter, or fax). Refunds will be made within 10 working days after receipt of the cancellation.
Article 6 – Risk during transport
The risk of damage, loss, or theft of products during shipment lies with the customer from the moment of delivery.
Article 7 – Right of withdrawal
7.1 You have the right to dissolve the agreement within 14 days of receipt without giving any reason. The purchase amount will be refunded within 14 working days, provided the product is returned unworn, unwashed, undamaged, and with original packaging and labels.
7.2 The costs for return shipment are for your own account.
7.2.1 Returns are exclusively processed via our partner Returnless. The return is only officially received after receipt of a confirmation with the subject ‘Refund’. Keep your Track & Trace carefully.
7.3 For hygienic reasons, beauty products, lingerie, swimwear, and scarves cannot be returned.
Article 8 – Guarantees
8.1 BYENTI.com guarantees that delivered products comply with the description on the website.
8.2 You must inspect the delivered product as soon as possible after receipt.
8.3 BYENTI.com is not liable for damage to products after wearing, washing, or incorrect maintenance, such as pilling.
8.4 Linen items must be washed by hand and cold. Tumble drying is not permitted. Our responsibility ceases after washing.
8.5 Color differences between photos on the website and reality are not covered by warranty.
Article 9 – Retention of title
All delivered products remain the property of BYENTI.com until full payment has been received.
Article 10 – Payment
10.1 You choose a payment method yourself when completing the order.
10.2 Delivery only takes place after payment has been received. For payments via Sofort Banking, the processing time is a maximum of two weeks.
Article 11 – Collection costs
If you do not meet your payment obligations, BYENTI.com has the right to charge extrajudicial collection costs in addition to statutory interest. These amount to at least 15% of the outstanding amount, with the possibility of higher compensation if proven.
Article 12 – Intellectual property rights
12.1 All rights to texts, images, designs, software, brands, domain names, and other content of the website belong to BYENTI.com or its licensors.
12.2 It is not permitted to reproduce parts of the website or make them available to third parties, except for personal use.
12.3 Changes to delivered products are not permitted, unless agreed upon in writing.
12.4 Creating a hyperlink to the website is only permitted for informative purposes. Commercial use is prohibited.
Article 13 – Liability
13.1 If a delivered product is defective, the liability of BYENTI.com is limited to the provisions in article 8.
13.2 Liability for damage is limited to the purchase price, unless there is intent, gross negligence, or improper use.
13.3 BYENTI.com is not liable for damage resulting from incorrect use of the website, incorrect information on the website, or misuse by third parties.
13.4 Mentions of programs, celebrities, or magazines on the website do not imply a commercial relationship. BYENTI.com is completely independent.
13.5 Exclusions of liability do not apply in cases of intent or gross negligence by BYENTI.com or its employees.
Article 14 – Force majeure
Neither party is obliged to fulfill obligations if this is prevented by force majeure, as described in law or generally accepted standards.
Article 15 – References to third parties
The website may contain references to third-party websites. byenti.com has no control over these websites and is not liable for their content.
Article 16 – Other provisions
16.1 Deviations from these terms and conditions are only valid if agreed upon in writing.
16.2 The administration of byenti.com serves as proof, unless proven otherwise. Electronic communication is accepted as proof.
16.3 www.byenti.com has the right to transfer rights and obligations from the agreement to third parties.
